Weed-A-Way reserves the right to modify these Terms of Use, either wholly or partially, at any time without prior notice. Therefore, it is advisable to review this page regularly before using the Weed-A-Way.com website and associated services to ensure that you understand the terms governing your access to this website.

Your use of the Weed-A-Way.com website and its associated services constitutes acceptance of the terms outlined herein. If you do not agree with these terms of use, you must discontinue your use of the Weed-A-Way.com website and/or services.

Continuous Service:

Your Weed-a-Way Lawn Care service continues from year-to-year for your convenience. If you wish to make changes to your service or discontinue it, please notify us at 905-858-3100 or at customerservice@weedaway.com. Reminders of our continuous service model will be included on all work orders as well as annual renewal notices sent in the fall via mail and email.

Limitation of Liability:

Weed-A-Way.com shall not be liable for any damages, whether direct or indirect, including but not limited to special, incidental, compensatory, exemplary, or consequential damages, losses, or expenses. This includes, but is not limited to, lost or misdirected orders, lost profits, lost registrations, lost goodwill, or lost or stolen programs or other data. This limitation of liability applies to any party’s use or inability to use this site, any failure or performance, error, omission, interruption, defect, delay in operation or transmission, or line or system failure, even if Weed-A-Way.com, its employees, or representatives have been advised of the possibility or likelihood of such damages, losses, or expenses.

Site Warranty:

The information, materials, and services provided on the Weed-A-Way.com website are offered on an “as is” basis with no warranty, except as specified in Weed-A-Way.com’s return of goods policy. Weed-A-Way.com does not warrant or guarantee the accuracy, adequacy, or completeness of this information and materials and disclaims liability for any errors or omissions therein. Weed-A-Way.com further disclaims all representations and warranties, whether expressed, implied, or statutory, including without limitation the implied warranties of title, non-infringement, merchantability, and fitness for a particular purpose.

Additionally, Weed-A-Way.com does not warrant, guarantee, or represent that accounts are secure, or that this site is free from destructive materials such as computer viruses, hackers, or other technical sabotage. Weed-A-Way.com does not guarantee uninterrupted or error-free access to this site.

Contact Information:

By providing your contact information to Weed-a-Way, including home phone number, cell phone number, or email address, you expressly consent for Weed-a-Way, along with its agents and affiliates, to contact you by telephone, text, or email with offers and other information regarding Weed-a-Way products and services. You represent and warrant that any mobile or wireless telephone number you provide belongs to you and is associated with a mobile device in your possession. You will notify Weed-a-Way if your contact information changes. Consent is not a requirement of purchase.

Payment Collections:

Payment for services is due upon receipt. For your convenience, we offer a discounted Pre-pay-visit option as well as an option to pay ‘Per Application’ and complete payments after services are rendered. Customer agrees that Weed-a-Way may contact Customer via telephone, text, or email in the event debit/credit card or bank account payment fails when processed. We offer several forms of payment options, including credit card payments, which can be completed via our website or over the phone, online banking payments, and payments via cheque.

Treatments and Pre-Notification:

Weed-a-Way will generally complete lawn treatment applications once every 4 to 6 weeks throughout our production season. Weather, soil, and general lawn conditions can affect the timing of certain services. As such, we do not guarantee the order with which we will complete all services or provide a full schedule of dates we will complete services at the onset of each year. We offer, upon request, an automated email or phone call the day before service that we are ready to perform.

Non-Discrimination Statement:

Weed-a-Way does not discriminate in our services on the basis of race, color, religion (creed), gender, sexual orientation, gender expression or identity, age, national origin (ancestry), disability, marital status, veteran or military status. We are committed to providing an inclusive and welcoming environment to all employees, customers, and vendor partners.

Refund Policy:

All sales are final, and refunds are issued as credit only. A 20% administrative fee will be deducted from the refund credit applied to your account.

In the event of relocation, services will be transferred to your new address.

Our Lawn Care Program Policy:

Lawn care services continue from season to season, as an automatic renewal. Here are the details of the terms and conditions:

  1. Enrollment in Auto-Renewal:
    By purchasing a service or subscription from Weed-a-Way Ltd., you are automatically enrolled in our Auto-Renewal program. However, you may cancel your enrollment by following the cancellation procedures outlined below.
  2. Automatic Renewal:
    By being enrolled in the Auto-Renewal program, you authorize Weed-a-Way Ltd. to automatically renew your subscription or service at the end of each subscription term unless you cancel your enrollment in accordance with Section 4 below. The renewal term will be the same as the original subscription term unless otherwise specified.
  3. Payment Authorization:
    By being enrolled in the Auto-Renewal program, you authorize Weed-a-Way Ltd. to charge the payment method you provide at the time of renewal for the renewal fee, including any applicable taxes and fees. Please note that for your privacy and security, we do not keep credit card information on file.
  4. Cancellation of Auto-Renewal:
    You may cancel your enrollment in the Auto-Renewal program at any time by contacting Weed-a-Way Ltd. customer service. Cancellation requests must be received at least 30 days before the commencement of services in the spring to avoid being charged for the next subscription term.
  5. Notification of Renewal:
    Weed-a-Way Ltd. will notify you via email or other means specified at the time of enrollment before each automatic renewal. This notification will be sent in the fall, leading up to the first visit in spring, and will include details of the upcoming renewal, including the renewal fee and renewal date. This ensures that every customer receives ample opportunity to make any necessary changes to their service.
  6. Service Commencement in Good Faith:
    Weed-a-Way Ltd. will begin services in the spring even if payment has not yet been received, as we act in good faith to provide timely and effective lawn care for our valued customers.
  7. Changes to Terms:
    Weed-a-Way Ltd. reserves the right to modify, suspend, or terminate the Auto-Renewal program or these Terms at any time without prior notice. Any changes to these Terms will be effective immediately upon posting on our website.
